JP Morgan Posts Loss Ahead Of Expected Fines


JP Morgan Chase reported something unusual today: a loss. The bank has been forced to set aside a huge cash reserve to cover expected fines and related legal costs. In the most recent quarter, the set-aside was so large — $9.1 billion — that it produced a net loss for the bank.

Kerry presses formula for resuming Mideast talks

AMMAN, Jordan (AP) ? U.S. Secretary of State John Kerry stepped up his drive Friday to get Israelis and Palestinians back to the negotiating table, facing Palestinian reluctance over his formula for resuming peace talks after nearly five years.

Kerry held more than 90 minutes of talks Friday morning with chief Palestinian negotiator Saeb Erekat in the Jordanian capital Amman, then was planning to meet Palestinian President Mahmoud Abbas in the West Bank town of Ramallah, a U.S. official said.

Kerry's helicopter trip to Ramallah was delayed for at least two hours. No explanation was given, and the U.S. diplomat continued phone contacts in the meantime. Still, a Palestinian official confirmed that Kerry was set to meet Abbas later Friday. Both officials spoke on condition of anonymity because they were not authorized to brief reporters.

At a stormy late-night meeting of their leadership Thursday, Palestinians balked at dropping a main condition for talks with the Israelis. They demand a guarantee that negotiations on borders between a Palestinian state and Israel would be based on the cease-fire line that held from 1949 until the 1967 war, when Israel captured the West Bank, Gaza Strip and east Jerusalem. Israel withdrew from Gaza in 2005.

Israel rejects preconditions on the talks, and the split casts a cloud of uncertainty over months of U.S. mediation efforts.

Hoping to push Israelis and Palestinians toward talks, President Barack Obama asked Israeli Prime Minister Benjamin Netanyahu to work with Kerry "to resume negotiations with Palestinians as soon as possible," according to a statement released by the White House late Thursday.

Previous Israeli governments twice negotiated on the basis of the 1967 lines, but no peace accord was reached. Besides disagreeing over how much land to trade and where, the two sides hit logjams on other key issues, including dividing Jerusalem and the fate of Palestinian refugees.

Netanyahu has given lukewarm endorsement to the idea of a Palestinian state but has not delineated his vision of boundaries, while demanding that the Palestinian recognize Israel as the Jewish state. Palestinians reject that, concerned that it would undermine their claims that millions of refugees and their descendants have the right to return to their original homes, lost in the 1948-49 war surrounding Israel's creation. Israel has rejected that claim outright.

After their late-night meeting, the Palestinians did not bring up their often-repeated demand that Israel stop building in Jewish settlements in the West Bank and east Jerusalem before talks could resume. One official said that if Israel accepts the 1967 lines as a basis, that would make most of the settlements illegitimate.

While Kerry has not publicized details of his plan, an Arab League decision Wednesday to endorse his proposal raised speculation that the Palestinians would agree. Abbas traditionally has sought the blessing of his Arab brethren before making any major diplomatic initiative.

Ahmed Majdalani, a Palestinian leader, said Kerry has proposed holding talks for six to nine months focusing on the key issues of borders and security arrangements.

He said Kerry would endorse the 1967 lines as the starting point of negotiations and assured the Palestinians that Israel would free some 350 prisoners gradually in the coming months. The prisoners would include some 100 men that Israel convicted of crimes committed before interim peace accords were signed in 1993. Israel has balked at freeing these prisoners in the past because many were convicted in deadly attacks.

Although the plan does not include a settlement freeze, it was not clear whether Israel would accept any reference to the 1967 lines.

Israeli Cabinet minister Yair Lapid said it was "too early to say" whether Kerry had found a formula for talks.

"Secretary Kerry has done a tremendous job in trying to put both sides together," he told The Associated Press. "Of course Israel is more than willing and has expressed its agreement to go back to the negotiation table, but apparently it's going to take a little more time."

While Israel has balked at Palestinian demands, the international community has largely rallied behind the Palestinian position on borders and Jewish settlements.

One of Wisconsin?s largest real estate developers wrote to Gov. Scott Walker to express his interest in buying several prominent state office buildings at the same time the Legislature was considering doing away with competitive bidding for such sales, according to newly released records.

Terrence Wall offered his cellphone number in the letter, urging that the ?appropriate person? call him to discuss possible deals for properties including the state crime lab, records obtained by The Associated Press show. Wall also offered his support for the change in the bidding process, an idea that originated with Walker.

Wall sent the letter on June 10. The Republican-controlled Legislature agreed 11 days later to allow no-bid sales of state properties over the objection of Democrats, who argued that it opened the door for political cronies to be cut special deals.

No doubt T. Wall will look to buy state properties, only to turn around and sell it back to the state for a profit years later, just like they did in Arizona.

But nondrinkers are a diverse bunch, and the reasons people have for abstaining affects their individual mortality risk, in some cases lowering it on par with the risk for light drinkers, according to a new study. Scientists calculated the mortality risk for each subgroup compared with the mortality risk for light drinkers, and they found that the risks varied markedly.

OSHA cites Ford's Buffalo plant over asbestos

Federal safety officials have cited Ford Motor Co.'s Buffalo-area plant for alleged asbestos violations.

The Labor Department's Occupational Safety and Health Administration has proposed fines of $41,800.

OSHA officials say inspectors found eight violations. One involved a pipefitter who they say was exposed to asbestos while working on a steam line. In other cases, OSHA says workers didn't wear respiratory protection while exposed to asbestos and that the company did not properly monitor work areas for the potentially cancer-causing substance.

Ford has 15 business days to respond.

The Dearborn, Mich.-based automaker didn't initially respond to a request for comment Wednesday.

    Memory decline may be earliest sign of dementia

    BOSTON (AP) ? Memory problems that are often dismissed as a normal part of aging may not be so harmless after all.

    Several research teams are reporting that noticing you have a decline in memory beyond the occasional misplaced car keys or forgotten name could be the very earliest sign of Alzheimer's.

    One study found that complaining of a memory decline preceded wider mental impairment by about six years. Another tied those changes to evidence of dementia on brain scans.

    The research involves memory lapses that are more pronounced than a mere "senior moment." These are bigger problems, such as getting lost while driving home.

    The studies were discussed Wednesday at the Alzheimer's Association conference in Boston.

    Nissan unveils Datsun GO in India

    Nissan yesterday unveiled the first 21st Century interpretation of its iconic Datsun brand. Called Datsun GO after the DAT-GO car of 1914, it will go on sale in India early next year at under INR400,000 (approx. $7,000).

    The Nissan Datsun GO is a 5-door hatchback with seating for 5, as well as a 1.2L engine mated to a 5-speed manual transmission. It stands 3,785 mm long (on a 2,450 mm wheelbase), 1,635 mm wide, and 1,485 mm tall.

    The Datsun GO will be the first of several Datsun models that will be launched later in 2014 in Indonesia, Russia, and South Africa.

    Chrome beta brings improved suggestions to address bar, Android users get new WebRTC benefits

    Google has rolled out some changes to its Chrome browser on a number of fronts today, with new betas hitting Windows, Mac, Linux and Android. For those on a traditional desktop or laptop, the biggest change comes to the address bar (or "omnibox," as Google calls it), which the company says will now offer suggestions based on the based on the recency of websites visited and deliver "more contextually relevant suggestions at the right time." Those using Chrome on an Android phone or tablet can apparently expect to see faster page loading times, as well as higher-quality web-based audio applications courtesy of the Web Audio API (Google has a MIDI Synth demo you can try out) and in-browser videoconferencing that's now possible thanks to the new WebRTC implementation.

    BPA-Free Plastics Going On Trial In Texas

    Scientists and lawyers are scheduled to debate the safety of certain "BPA-free" plastics this week in a U.S. District Court in Austin, Texas.

    At issue is whether a line of plastic resins marketed by Eastman Chemical contains chemicals that can act like the hormone estrogen, and perhaps cause health problems.

    The court battle has attracted attention because the Eastman resins, sold under the name "Tritan," have been marketed as an alternative to plastics that contain an additive called BPA. BPA has been shown to act a bit like estrogen, though it's not clear whether people are affected by the small amounts that come from plastic water bottles or food containers.

    Eastman has sued two small companies based in Austin, Texas, that published a study showing that a wide range of plastic products exhibit what's known as estrogenic activity. Some of the products were made from Eastman's Tritan.

    Eastman's suit says PlastiPure and CertiChem have made false or misleading statements about Tritan in marketing their own services. CertiChem tests plastic products for estrogenic activity. PlastiPure, a sister company, helps manufacturers make plastic products with no estrogenic activity.

    Both companies were founded by George Bittner, a professor at the University of Texas at Austin and an author of the study that found estrogenic activity in most plastics. The study included tests of plastic products that had been subjected to heat, wear and radiation intended to mimic exposure to sunlight.

    "We certainly thought the results were not going to be greeted with favor by at least some plastic manufacturers," Bittner says. But, he says, "by bringing suit, Eastman Chemical has effectively put its Tritan product on trial."

    Eastman Chemical wouldn't comment for this story. But in an interview last year, Lucian Boldea, a vice president of the company, said Bittner's study used a screening test for estrogenic activity that is known to produce false positives.

    "To misrepresent a screening test as conclusive evidence is what we have the issue with," he said.

    Bittner responds that the study included a second test that ruled out false positives.

    Expert testimony about the various tests is likely to be a big part of the trial, says Rebecca Tushnet, a law professor at Georgetown. "I think it really depends what the evidence shows about these tests," she says. "And that really is a matter for experts."

    This case includes some complex and competing scientific arguments, Tushnet says, which are often difficult to present in court. And even when the science is less nuanced, she says, it can be a challenge for judges and juries.

    "Courts have a very ambiguous relationship to science," she says. "Sometimes they really defer to it and sometimes they are really skeptical of it. So it can be hard to predict what's going to happen in any particular case."

    At least one piece of evidence likely to come up during the trial could prove embarrassing to Eastman. A supposedly independent study that appears to vindicate Tritan was actually paid for by Eastman, even though that wasn't disclosed in the published article, according to court documents.

    If Eastman prevails, it will probably mean the end of PlastiPure and CertiChem. The suit has already caused big problems for the companies, says Mike Usey, the CEO of PlastiPure. "More than half the people that were at CertiChem and PlastiPure before the suit are now gone," he says

    Even so, Usey says he's optimistic about the companies' future. "One of the good things that should come out of this suit is more consumer awareness of what the real issues are and what solutions are immediately available."

    Whether or not that happens, the suit is a strong indication that the public debate is no longer about BPA alone but about whether plastics contain any chemicals with enough hormonal activity to affect people.

    Microsoft Cuts Surface RT Price to $349

    Microsoft has reduced the price of its Surface RT tablet by $150. Originally priced at $499, the 32GB Surface RT now costs $349, while the price of the 64GB model is reduced from $649 to $499.

    The price cut signals that Microsoft is probably sitting on a large amount of inventory of the device, which the company wants to sell before the next generation of Surface products arrive, likely this fall with the release of Windows 8.1.

    Microsoft reportedly ordered 3 million units for the original launch of the device last fall, but has sold only about 1.5 million, according to a report from Bloomberg. The device received tepid reviews when it debuted, although Microsoft has pushed out many updates since then, and Windows CMO Tami Reller told Mashable in May that the software upgrades have made the Surface RT a "different product" than the tablet that was released in October.

    The Surface RT is the version of the Surface that runs Windows RT, meaning it can't run apps designed for older versions of Windows. This was probably a factor in consumer disinterest, particularly since the tablet's chief competitor, the iPad, boasts 350,000 dedicated apps ? and the Windows Store has only recently hit 100,000.

    LAC-MEGANTIC, Quebec ? Two residents of a Quebec town devastated after an oil train derailment killed 50 people have registered a motion to file a class-action lawsuit against the U.S. rail company and some of its employees.

    One resident is Yannick Gagne, who owned the Musi-Cafe bar where many died in the July 6 disaster.

    The other is Guy Ouellet, whose partner was killed.

    The defendants include the Montreal, Maine & Atlantic railway, chairman Edward Burkhardt and president Robert Grindrod.

    The court documents were filed Monday in Quebec Superior Court.

    No financial sum is mentioned.

    Yves Bourdon, a member of the railway's board of directors, says he is not in a position to comment.
